Getting your money

If you win but the defendant does not pay, you will need to take enforcement action. There are four methods of enforcement. These are -

  • a warrant of execution
  • an attachment of earnings order
  • a third party debt order
  • a charging order.

The warrant of execution is probably the best known method. It gives court bailiffs the authority to collect the money you are owed or, alternatively, take some of the defendant’s possessions to be sold at auction to raise the money. If your claim is for a protected housing deposit, your deposit will be refunded by the relevant protection scheme so you will not need to take enforcement action. For more information on protected housing deposits click here.
